1. About the assessment
BDM Growth Systems provides a free, early-stage business assessment for New Zealand businesses. It is designed to gather context about a workflow, bottleneck, follow-up problem, or possible improvement so Brigham can review the information personally.
A completed assessment means that you have submitted the intake form and completed the Daisy conversation. Submitting the form alone does not start the call or create an obligation to complete it.
By using the website, submitting the assessment form, or speaking with Daisy, you agree to these terms. If you do not agree, do not use the assessment.
2. Daisy is a discovery-led AI system
Daisy is an AI system used to ask discovery questions and gather information. Daisy is not a human consultant and may misunderstand, omit, or incorrectly summarise information. The conversation is not a final assessment, recommendation, proposal, or promise of results.
Brigham personally reviews every completed assessment and supplies the personal review within three working days. The review summarises what BDM Growth Systems understood, identifies any practical opportunities, and indicates confidence in each recommendation. It may conclude that no worthwhile custom automation opportunity is apparent or suggest an existing tool instead. BDM Growth Systems is not required to recommend or provide further work.
3. Recording and transcription
BDM Growth Systems, ElevenLabs, and their service providers may record, transcribe, view, store, and share Daisy assessment conversations to provide, review, secure, and improve the assessment. Those service providers may include third-party AI model providers. A conversation should only start after you have been given notice and have consented to that processing. Submitting the intake form does not automatically start the conversation. The assessment page provides notice before the call.
If you do not consent, do not start the Daisy conversation. You may still submit the intake form and contact BDM Growth Systems by email at brigham@bdmgrowth.co.nz. If consent is withdrawn during a conversation, end the call and contact us to discuss the information already collected.
4. Your responsibilities
You agree to:
- provide information you are authorised to share;
- avoid passwords, payment-card details, health information, confidential client records, trade secrets, and other sensitive information;
- not use the website, form, or Daisy for unlawful, abusive, misleading, or harmful purposes; and
- check important details independently before relying on a summary or taking action.
5. No professional advice or guaranteed outcome
Information from the website or assessment is general and exploratory. It is not legal, financial, accounting, employment, cybersecurity, health, or other regulated professional advice. Do not make important decisions solely from Daisy's responses or an automatically generated summary.
BDM Growth Systems does not guarantee that an opportunity will be identified, that a suggested idea is feasible, or that any future work will save a particular amount of time or money. Any later project will require separate scope, pricing, and approval. The free assessment creates no obligation to purchase anything.
6. Availability and third-party services
The website, intake flow, voice agent, email, transcripts, and related features rely on third-party services, including ElevenLabs and its AI or service providers, ChatGPT Sites (OpenAI), and Microsoft 365. Features may be unavailable, delayed, changed, or interrupted. We may modify, pause, or withdraw the assessment at any time.
Links to third-party websites are provided for convenience. Their own terms and privacy policies apply when you use them.
7. Intellectual property
BDM Growth Systems retains ownership of the website, assessment structure, branding, and original materials it provides. You retain ownership of information and materials you submit. You give us permission to process that material only as reasonably needed to provide, review, secure, and improve the assessment in accordance with the Privacy Policy.
8. Responsibility and New Zealand consumer rights
To the extent permitted by law, BDM Growth Systems is not responsible for indirect or consequential loss resulting from use of, or inability to use, the free assessment or from reliance on AI output. Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded, including any applicable rights under New Zealand law.
9. Privacy
Our Privacy Policy explains how information is collected, used, disclosed, stored, and corrected. It forms part of these terms.
10. Changes, governing law, and contact
We may update these terms as the assessment develops. The latest version will be posted here with its updated date. These terms are governed by New Zealand law, and New Zealand courts have non-exclusive jurisdiction.
